1. General Provisions

This document is a public offer by the Individual Entrepreneur Mamontov Mikhail Nikolaevich, hereinafter referred to as the "Seller," and governs the sale of NAMEØ brand products through the website namezero.shop.

This offer contains the terms and conditions for purchasing goods, payment, delivery, exchange, and return of goods, and also defines the rights and obligations of the Seller and the Buyer.

By placing an order on the namezero.shop website, the Buyer confirms that they have read and fully accept the terms of this document, and confirms that they have reached the age of 18 or have the appropriate consent of their legal representatives.

These relations are governed by the legislation of the Kyrgyz Republic, including the Law of the Kyrgyz Republic "On Protection of Consumer Rights" and the Law of the Kyrgyz Republic "On Personal Information".

2. Terms and Definitions

The following concepts are used within this offer:

• Website — the website namezero.shop, where NAMEØ brand products are hosted.
• Seller — Individual Entrepreneur Mamontov Mikhail Nikolaevich, who sells the goods.
• Buyer — a legally capable individual who has reached the age of 18, placing an order and paying for the goods.
• Goods — NAMEØ brand items, including clothing and accessories presented on the website.
• Order — a request placed by the Buyer to purchase the goods.
• Offer — this document, publicly available on the namezero.shop website.

3. Subject of the Agreement

The Seller undertakes to transfer to the Buyer the goods selected and paid for through the namezero.shop website, and the Buyer undertakes to accept the goods and pay their cost.

Information about each product is posted on the website and includes:

• item name;
• photographs;
• model description;
• material characteristics;
• available sizes;
• price of the item.

The Seller undertakes to transfer the goods corresponding to the information posted on the website and specified in the Buyer's order.

4. Order Placement

The Buyer independently selects the desired item, size, and quantity of items on the namezero.shop website.

When placing an order, the Buyer must provide accurate information:

• Full name of the recipient;
• phone number;
• email address;
• delivery address;
• other data necessary for the fulfillment of the order.

Before paying for the order, the Buyer must independently verify the correctness of the selected item, size, and specified data.

After placing an order, the Seller has the right to contact the Buyer to confirm the information.

The fact of payment for the order confirms the conclusion of the agreement between the Seller and the Buyer.

5. Price and Payment

The price of the goods is indicated on the namezero.shop website at the time of order placement.

The Seller has the right to change the price of the goods before the Buyer places and pays for the order.

After full payment of the order, the price of the goods cannot be changed.

Payment is made in the amount of 100% of the order value, unless otherwise specified on the website.

Available payment methods are determined by the Seller and displayed during checkout.

When paying by credit card, the payment is processed through a payment system or banking organization that ensures the transaction.

The Seller does not receive or store the full details of the Buyer's credit card.

The Seller is not responsible for the refusal of a payment due to reasons related to the bank, payment system, or actions of third parties.

6. Delivery of Goods

Delivery of goods is carried out by the methods specified on the website or agreed upon with the Buyer when placing the order.

Delivery time depends on the selected delivery method, destination region, and the operation of transport organizations.

The Buyer must provide correct delivery details.

In case of providing incorrect data resulting in the impossibility of delivering the goods, the Buyer bears responsibility for the consequences.

After transferring the goods to the transport organization, the responsibility for delivery times is determined by the rules of the respective delivery service.

The Buyer must check the integrity of the packaging and the appearance of the goods upon receipt.

7. Quality of Goods

The Seller guarantees that the goods transferred to the Buyer match the description posted on the namezero.shop website and do not have manufacturing defects that prevent their intended use.

The Buyer understands and accepts that the color of the item in the photograph may slightly differ from the actual color of the goods due to screen settings, lighting during photography, and other technical factors.

Minor differences in shades, material texture, the arrangement of decorative elements, or manual production features are not considered a defect in the goods and do not constitute grounds for declaring the goods defective.

Before placing an order, the Buyer independently reviews:

• the item description;
• photographs of the goods;
• material characteristics;
• the size chart;
• recommendations for choosing a size.

The Seller provides the most accurate product information necessary for the Buyer to independently choose the appropriate item.

8. Limited Edition NAMEØ Items

The Buyer is notified and agrees that NAMEØ brand goods may be specially manufactured and supplied in limited quantities.

Due to the specific nature of production, procurement, and logistics, certain items may be purchased exclusively for a specific Buyer's order.

Before purchasing, the Buyer must independently select the appropriate size based on the provided size chart.

By placing an order, the Buyer confirms that they are familiar with the specifics of NAMEØ's limited production and accept the terms of this section.

9. Exchange and Return of Goods

The return and exchange of goods are carried out strictly in accordance with the Law of the Kyrgyz Republic "On Protection of Consumer Rights".

9.1. Return of Good-Quality Items

The Buyer has the right to exchange or return a non-food item of good quality (if it does not fit in shape, dimensions, style, color, size, or configuration) within 14 (fourteen) days, excluding the day of purchase.

The return of good-quality items is allowed exclusively subject to the simultaneous observance of the following conditions:

• the item has not been used (there are no signs of wear, washing, or extraneous odors);
• its presentation and consumer properties are fully preserved;
• all seals, original packaging are preserved, and factory labels are not cut off;
• there is a document confirming the fact and terms of purchase of the specified goods (electronic receipt, bank statement).

In the event of a violation of at least one of the above conditions, the Seller reserves the legal right to refuse the return of the good-quality item. Transportation costs for the return of good-quality items are paid by the Buyer.

9.2. Return of Defective Items

The Buyer has the right to request a return of the goods in the following cases:

• receipt of goods of inadequate quality (manufacturing defect);
• receipt of goods that do not match the placed order.

To process any type of return request, the Buyer must send a written notice to the Seller's email:

The request must include:

• Full name of the Buyer;
• order number;
• description of the reason for the request (if a defect — a detailed description and close-up photographs of the defect).

10. Refunds

Refunds are processed only after the Seller receives the goods, conducts a technical inspection of the item's condition (preservation of tags or confirmation of the defect), and confirms the grounds for a return.

In case of confirmation of a manufacturing defect or the Seller's error during order fulfillment, funds are returned to the Buyer in the amount of the full cost of the goods, and return shipping costs are compensated. When returning a good-quality item, the delivery cost is non-refundable.

The refund is made using the same method that was used for payment. The timeline for crediting the funds depends on the issuing bank and can range from 3 to 30 business days from the moment the return is confirmed by the Seller.

11. Liability of the Parties

The Seller and the Buyer are responsible for fulfilling their obligations in accordance with this offer and the current legislation of the Kyrgyz Republic.

The Seller is not responsible for:

• errors made by the Buyer when specifying contact details or delivery addresses;
• the inability to use the goods for reasons related to the individual characteristics of the Buyer;
• the operation of banks, payment systems, transport companies, and other third parties.

The Buyer bears full legal responsibility for the accuracy of the information provided when placing an order and confirming their legal age.

The Seller has the right to refuse to fulfill an order in case of objective impossibility to fulfill it, notifying the Buyer and processing a refund if necessary.

11.1 Force Majeure

The Parties are released from liability for partial or complete failure to fulfill obligations if such failure is caused by force majeure circumstances.

12. Privacy Policy and Data Collection

This section outlines the Seller's policy regarding the collection, processing, and protection of personal and analytical data of users in accordance with the Law of the Kyrgyz Republic "On Personal Information".

12.1. Age Restriction

The namezero.shop website and provided services are not intended for persons under the age of 18. By performing actions on the Website, the Buyer guarantees that they have reached the age of majority. The Seller does not intentionally collect data from minors.

12.2. Consent to Personal Data Processing

By placing an order or continuing to use the Website, the Buyer gives their full and irrevocable consent to the collection, recording, systematization, accumulation, storage, and use of their data. The Seller collects the following personal data:

• Full name;
• phone number;
• email address;
• delivery address.

12.3. Collection of Analytical and Metric Data (Cookies)

To improve service quality, target advertising, and analyze user experience, the Website automatically collects technical data via "cookies" and metric services (including, but not limited to: Yandex.Metrica, Google Analytics, and similar systems).

The following anonymized data is subject to collection:

• User IP address and location data;
• device type, operating system, and browser type;
• referral source (referrer);
• age and gender groups (based on metric system algorithms);
• page visit history, time spent on the Website, and clicks.

The User has the right to block the use of "cookies" at any time by changing their web browser settings; however, the Seller does not guarantee the correct operation of the Website in such an event.

12.4. Data Transfer to Third Parties

Personal data is used exclusively to fulfill obligations to the Buyer. The Seller has the right to transfer necessary data (full name, address, phone) to third-party transport, courier, and logistics companies strictly for the purpose of delivering the Goods, as well as to payment gateways to process transactions. Any other data transfer is permitted only upon a lawful request by authorized state bodies of the Kyrgyz Republic.

The Seller takes all necessary organizational and technical measures to protect the Buyer's personal data from unlawful or accidental access, destruction, alteration, blocking, and copying.

13. Amendments to the Offer Terms

The Seller reserves the right to unilaterally amend the terms of this offer and the privacy policy at any time without prior notice to the Buyer.

The new version of the offer takes effect from the moment it is published on the namezero.shop website, unless otherwise specified in the new version of the document.

Orders placed before the changes to the offer terms are subject to the document version that was in effect at the time the order was placed.

14. Dispute Resolution

All disputes and disagreements between the Seller and the Buyer shall be resolved through negotiations with mandatory compliance with the pre-trial claim procedure.

The Seller reviews the received claim within 10 (ten) business days and provides a reasoned response.

If the parties fail to resolve the dispute through negotiations, the dispute is subject to consideration in the judicial instances at the Seller's location in accordance with the procedural legislation of the Kyrgyz Republic.
